Jagan Gets Big Relief From CBI Court

In a big relief to YSR Congress party president Y S Jaganmohan Reddy, the special court for CBI cases on Tuesday relieved him of two major charges filed against him in the CBI charge-sheet in connection with his alleged illegal assets case.

The CBI court, while taking cognizance of the fifth charge sheet filed against Jagan, refused to acknowledge charges made against him under Section 409 (Criminal Breach of Trust) of the Indian Penal Code and Section 12 of the Prevention of Corruption Act. The court apparently felt that Jagan had not resorted to any breach of trust of the investors who had put in money in his business empire by purchasing shares at high premium.

At the same time, the court felt that the Prevention of Corruption Act would not be applicable to Jagan as he was not a government servant nor was he a part of the government.

However, it is not immediately known as to whether the CBI court observations pertained only to fifth charge sheet pertaining to investments made by Dalmia Cements or to all the previous charge sheets.
